Terms and conditions of sale

1. PURPOSE

The purpose of these general terms and conditions of sale is to define the rights and obligations of "ATELIER BLEU DE COCAGNE®" and the Customer for the purchase of products presented by "ATELIER BLEU DE COCAGNE® " on its website www.bleudecocagne.fr (hereinafter "the Site"). They apply exclusively between SARL Apparel Architecture, 68 cours de Vincennes Vincennes - 75012 Paris, Siret: 801.934.787.00038 (hereinafter "ATELIER BLEU DE COCAGNE®") and any individual consumer visiting or making a purchase via said Site (hereinafter "the Customer").

On the website, "ATELIER BLEU DE COCAGNE®" enables customers to order the brand's products online.

The photos of the products marketed on the store are intended to represent reality as closely as possible. However, "ATELIER BLEU DE COCAGNE®" cannot be held responsible for potential variations, particularly with regard to color perception.

2. THE CUSTOMER

• The Customer undertakes to provide " ATELIER BLEU DE COCAGNE® " with the actual information required to carry out the service that is the subject of the present terms and conditions, as requested online and according to his/her situation, in particular his/her surname, first name, address, telephone number and valid e-mail address.
• The customer is liable for any consequences arising from the transmission of false or inaccurate information, or the unlawful use of such information.
• Customers can modify their data in the "My account" section.

3. ORDER

• Once the order has been placed, " ATELIER BLEU DE COCAGNE® " will send the Customer an e-mail confirming the order.
• "ATELIER BLEU DE COCAGNE®" reserves the right to cancel or refuse an order in the event of a dispute with the Customer over a previous order.
• "ATELIER BLEU DE COCAGNE®" can accept orders while stocks last.

If, despite the vigilance of " ATELIER BLEU DE COCAGNE® ", the products are unavailable, " ATELIER BLEU DE COCAGNE® " will inform the Customer by e-mail within 48 hours of the order. The Customer will then be able to cancel the order and be reimbursed for any sums already paid.

ATELIER BLEU DE COCAGNE® shall in no way be held liable for any permanent or temporary unavailability, nor shall such unavailability entitle the Customer to any compensation or damages whatsoever.

4. RATES

For sales within the EEC, the prices shown in the catalog are inclusive of VAT in Euros, applicable on the day of the order.

"ATELIER BLEU DE COCAGNE®" reserves the right to modify its prices at any time, it being understood however that the price appearing on the site on the day of the order will be the only one applicable to the buyer.

The prices shown include order processing costs, but do not include shipping and delivery costs.

5. CUSTOMS DUTIES

In the event of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. For all products shipped outside the European Union and French overseas departments and territories, the price will automatically be calculated exclusive of tax on the invoice. Customs duties, local taxes, import duties or state taxes may be required. These duties and sums are not the responsibility of " ATELIER BLEU DE COCAGNE® ". They will be at your expense and are your sole responsibility, both in terms of declaration and payment to the competent authorities and organizations in your country.

Prices are in euros.

The buyer will therefore be debited in the currency indicated on a euro basis.

6. METHOD OF PAYMENT

Payments are made by credit card or via Paypal. We accept the following cards:

7. SHIPPING/DELIVERY/RETURN TERMS

The delivery service used is "Colissimo".

Shipping costs vary according to the number of items ordered and the destination.

Products are dispatched with the delivery note, to the delivery address indicated by the Customer at the time of ordering.

Delivery cannot be made to hotels or P.O. boxes.

The delivery times indicated on the site are indicative, corresponding to average processing and delivery times. In order for these times to be respected, the Customer must ensure that he has provided accurate and complete information concerning the delivery address (such as, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, etc.).

We deliver Monday to Friday.

We will try to deliver your package at least twice to the delivery address. We reserve the right to cancel your purchase if no one has signed for your package.

You are responsible for the package once it has been delivered.

8. RETURN PROCEDURE

Within fifteen (15) days of receipt of the order, the Customer may ask "ATELIER BLEU DE COCAGNE® " to refund or exchange the Product(s). To do so, please send us an email via contact@bleudecocagne.com specifying the reason for the return.

For France, we will send you a free return slip.

For other countries, the return is at the customer's expense, unless the product shipped presents an error in Style/Size/Color compared to the order or an indisputable quality defect.

The Product must be returned in its original packaging, in its original condition, new, unworn, unwashed, to the following address:

• The return will be reimbursed according to the method of payment you used once it has been received and checked.
• Please allow 15 days from receipt of your return for the refund to appear on your statement.
• To receive another item to replace your returned item, you will need to place a new order online.

Should the Customer fail to comply with the present conditions, in particular the return or exchange conditions, "ATELIER BLEU DE COCAGNE® " will not be able to reimburse the Products concerned.

9. SECURITY AND CONFIDENTIALITY

The security and confidentiality of your data is a priority for " ATELIER BLEU DE COCAGNE® ". The data you enter is instantly encrypted on your computer before being sent to us (thanks to "SSL" information encryption technology).

To keep track of your preferences and the products you place in your shopping cart, we use "cookie" technology. These are small text files stored by your web browser on your hard disk. These files can be deleted between orders.

In accordance with the "Loi n°2004-801 du 6 août 2004, Loi relative à la protection des personnes physiques à l'égard des traitements de données personnelles et modifiant la loi n°78-17 du 06 janvier 1978 relative à l'informatique, aux fichiers et aux libertés", you have the right to access, modify, rectify and delete any personal data concerning you. 10. WARRANTIES AND LIABILITY

"ATELIER BLEU DE COCAGNE®" has only an obligation of means for all stages of access to the site, from the order process to dispatch of the parcel or subsequent services. ATELIER BLEU DE COCAGNE® " shall not be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, external intrusion or the presence of computer viruses, or for any event qualified as force majeure, in accordance with the law and jurisprudence.

11. RIGHT OF " ATELIER BLEU DE COCAGNE® " TO REFUSE ORDERS OR CANCEL PURCHASES

We reserve the right to refuse any order or cancel any purchase for any reason whatsoever. We also reserve the right to cancel any purchase (an order we have already accepted) in the following situations (among others), without being liable for any damages or costs:

• the product is not available / in stock (all payments will be refunded)
• bank details are incorrect or unverifiable
• the order has been detected by our security systems as unusual or likely to be a fraudulent act
• we were unable to deliver the package to the address indicated.
